Can Foreign Nationals Work In The United States?

The H-1b Cap Has Been Met; What Is Left For The Foreign National Who Wants To Work Legally In The United States?

(PRWEB) May 31, 2007 -- New York Immigration attorney Elise Schwarz comments on the recent introduction of the yearly cap on the number of H-1B visas granted to foreign nationals in specialty occupations and why it has been effectively withdrawn, at least until April 2008.

The first day to file the application for the visa this year (to become eligible to work in October 2007) was April 1, 2007. "The cap was pretty much reached on the very first day," states Schwarz. Foreign nationals holding a Masters degree or higher from a U.S. University had the advantage of an additional 21,000 chances to get the visa. But that cap was reached in the first month. While nationals of certain countries and employees of certain organizations receive more welcoming conditions and exemptions in this visa category, for the most part, the H-1B has had its day, at least for this year.

"All is not lost, however, for many foreign nationals who want to work in the United States in a non-immigrant capacity," continues Schwarz. "There might still be a visa that fits."

Under the North American Free Trade Agreement, Canadians and Mexicans whose occupations are one of 64 listed under the NAFTA schedule can come in to the United States to work under the TN-1 and TN-2 visas, respectively. Like every other non-immigrant visa, the individual must show that he or she does not have intent to remain in the United States permanently.

Other treaty based visas fall under the "E" category. If a national is from a country with which the United States has signed a Treaty of Commerce and Navigation E-1 and E-2 visas are available for the purposes of trade and investment. The E-1 treaty trader must be coming to the United States to carry on substantial trade between the United States and his or her country of nationality.

The E-2 treaty investor must be coming to the United States to develop and direct an operation or enterprise in which he or she has invested, or is actively in the process of investing, a substantial amount of capital. Executives and specialized employees may also qualify for this visa.

The E-3 visa, also treaty based, is available to Australian professionals who come to the United States to perform a professional specialty occupation. The qualifying Australian must have a Bachelor's degree and the position that person will fill must typically require a related bachelor's degree for entry-level employment.

For those from countries other than those with which the United States has signed a treaty, or for whom, for whatever reason, a treaty-based visa is not appropriate, other visas are available. Individuals employed by, or owners of, businesses abroad, can qualify for a B-1 visa to come to the United States and perform services here which benefit their foreign employer or business. Although they cannot accept local employment in the United States and must not render productive services here, this is, nonetheless, an extremely useful visa for those who, for example, need to attend numerous business meetings or negotiate a cross-border deal. Indeed it is used by a range of individuals in a range of circumstances, including foreign corporate personnel who come to the US to set up a subsidiary; individuals exploring the possibility of investing in the U.S.; those attending an executive seminar or those participating in scientific, educational, professional, religious or business conventions, to name a few. The visa can be issued for "as long as is reasonable for the business to be performed" although it is typically issued for an initial six months to one year, it can then be extended in six month increments so long as the purpose for the visa remains.

Plenty of visas are available that do allow for gainful employment in the U.S. Managers, executives, and those in a position requiring specialized knowledge, who work for U.S. firms, corporations, or other legal entities or their affiliates or subsidiaries of a company abroad, and have done so for one year out of the last three, can come to the U.S. on an L visa for intra-company transfers.

Those coming to the US to do on-the job training have two main options. The H-3 visa is available to individuals coming to the United States to complete training which is not available in their home country. This visa, however, can be issued for a maximum of 24 months only. If the individual requires an extended period of stay, a more suitable visa is likely to be the J-1. The J-1 is an ideal visa for students and professors, au pairs and nannies, as well as industrial trainees and specialists, although it does require a sponsoring entity. The J-1 is initially valid for eighteen months, but various waivers and extensions are available.

And there's more. The O category of visa is available to those foreign nationals who can prove their extraordinary ability in the arts, sciences, business, education or athletics, or extraordinary achievement in film or television. There is even a related visa for their accompanying essential support personnel. Internationally recognized entertainment groups and sports teams can work in the United States under the P visa. Religious workers may come to the United States to work in their religious professions or vocations under the R visa. Foreign press, radio, film, or other foreign media personnel can use the I visa. And for the culturally curious, the Q visa is available for cultural exchange programs which have been designated for the purpose of providing practical training, employment, and the sharing of history, culture and traditions of the country of aliens nationality.

There are other visas available, including some which are not based on the recipient's own employment but allow that individual to work nonetheless.

While none of these visas fully substitutes the general applicability and availability of the H-1B visa across the board for professional specialty occupations, it is clear that, perhaps with some further probing of a foreign national's specific circumstances, oftentimes, there is another option which will make it possible for that individual to come and work legally, prosperously, and, hopefully, mutually beneficially, in the United States.

MY TOLERANCE FOR PAIN was put to the test this week, courtesy of a fractured-tooth/root-canal/realization-that-my-dental-insurance-lapsed-in-December triple shot. So as I attempt to rationalize the expenditure of a ton of cash in order to preserve my ability to nosh on Skittles, I figure I might as well continue on the masochist track with a review of the National Enquirer.

I'm not a gossip guy, which isn't to suggest that I consider myself intellectually above pinhead pursuits (anyone else dork out over Tom Gorzelanny's slightly lowered arm angle last night? I didn't think so). As entertaining in a karmic-retribution sense as the "news" that Paris Hilton will be heading to the pokey may be, I can get by without the mag's speculation about the reception she'll receive (a wild guess: sex-ay!). Similarly, a pleasant, successful afternoon isn't premised on my reception of updates on the status of Burt Reynolds' love life, Posh Spice's shopping jags and the former Miss Nevada's alleged whoredom. There are plenty of other things to read while waiting for a haircut, like the backs of Pantene bottles and religious-cult pamphlets.

And yet I kinda dig the Enquirer. Maybe that's the Percocet speaking -- I started to review a Lands' End catalog just now before realizing it wasn't a magazine -- but it seems to me that the Enquirer has refined its act over the years. Of all the gossip rags, it's the one that doesn't seem ashamed of what it is.

Hell, the mag practically basks in its low-mindedness, appending its most shocking declarations with a string of exclamation points and landing many an agenda-laden cheap shot (like an out-of-nowhere reference to Alec Baldwin as "Bozo McBoom-Boom"). The "secrets" the mag "exclusively" reveals are "tragic," "explosive" or some variation thereof. The Enquirer is not subtle in its approach, to put it mildly.

At the same time, outside of gossip grand dame People, few weekly titles can match the Enquirer's skillful presentation. I don't know how to describe it, other than to say that everything is precisely where it ought to be. Take the cover feature on "Plastic Surgery Shockers," which presents the before-and-after evidence in a way that's ideal for quick consumption. While I didn't need to see Courtney Love's shriveled stomach before breakfast, I was impressed (and more than a little embarrassed about being impressed) by the authority with which the mag made its cases.

The Enquirer also excels at making news out of nothing at all. To meet its Brad/Angelina and Lohan quotas, the mag takes a one-line premise (say, "Lindsay falls off the wagon") and somehow grows it into a 800-word feature replete with thematically on-point photos (Lindsay with her eyes looking like recessed blinds, etc.). It's a simple recipe, I suppose. You mix a few paragraphs of anonymously sourced dirt with a sprinkling of opinions from experts (who, the mag takes pains to point out, have not treated the subject they're weighing in on), and voilà: tabloid nirvana.

You've gotta wonder, actually, about the mag attributing almost every nugget to "a friend," "an insider," "an eyewitness" or "a source" ("Lindsay is also drinking alcohol. Her favorite is vodka. She pours it into a 16-oz. water bottle and drinks it straight or mixed with some soda. But she also drinks tequila and champagne," a "friend" tells us). On the other hand, the Enquirer rarely gets popped for libel -- the "truth" defense must be the magazine's get-out-of-jail-free card -- so I probably have no point here.

Slightly more diverting are the items in the May 21 issue that have nothing to do with celebrity. The mag doesn't merely convey what happened; it relates the "news" in a way that practically instructs readers how they should feel about it. Therefore we give a big thumbs-up to the dad jailed for 10 years after going all Dirty Harry on his daughter's drug dealer, and a huge razz to the sister who refuses to donate bone marrow to her ailing brother. In each instance, we're only treated to one side of the story, leaving me to wonder if most Enquirer fans realize how skillfully they're being manipulated.

Holy lord -- I just took the National Enquirer seriously. I'm going to go dunk my head in the sink now.

My favorite part of the May 21 issue could well be the trio of letters tucked away in the back, next to astrology and chat-line classifieds. I don't know why I find it so entertaining that an actual person would be motivated to send the Enquirer a missive that begins, "Why doesn't Eddie Murphy take a paternity test? That way he'll know whether he's the father of Melanie Brown's baby." But so help me, I do.

Perhaps it's the cash. The mag hands out $50 to the composer of its "Letter of the Week" and $25 for all other published submissions. Hence the note that I just zipped off to letters@nationalenquirer.com: "Gary Coleman has some nerve shouting at a woman trying to get an autograph for her wheelchair-bound kid! He should remember that it's the fans who got him to where he is today! He is a very small person -- and I'm not just talking about his height!!!!!!!!!" Send the $50 straight to my endodontist, will you?

Pharmaceutical Company Agrees to Pay Government $9.8 Million to Settle Whistleblower Claims

Medicis Pharmaceutical Corp. will pay $9.8 million to settle allegations that it promoted the use of a topical skin preparation for unapproved use.

Overland Park, Kan. (PRWEB) May 9, 2007 -- "Medicis Pharmaceutical Corp. will pay $9.8 million to settle allegations that it promoted the use of a topical skin preparation for unapproved use," the United States Department of Justice said Tuesday (Case 04-2389 in federal court in Kansas).

The four whistleblowers, represented by Brous Horn LLC of Overland Park, Kan., informed the government of the pharmaceutical company's allegedly illegal marketing practices that resulted in the settlement.

The four were former Medicis sales representatives who alleged that Medicis trained them to market one of its drugs to doctors for an off-label use, not approved by the Federal Drug Administration (FDA).

The whistleblowers alleged that they were trained to market a prescription drug called Loprox to pediatricians for use on children under the age of 10 to treat diaper rash and other skin conditions. The FDA has never approved the use of Loprox on children under the age of 10.

"Although doctors can prescribe medications to patients for off-label uses," says attorney Carrie Brous, Brous Horn, Overland Park, Kan., "it is illegal for pharmaceutical companies to market their drugs to doctors for off-label uses."

Medicis allegedly misused federal and state funds by marketing Loprox off-label to doctors, causing claims to be submitted to Medicaid for Loprox dispensed for the treatment of children under 10 years of age.

"Because of the False Claims Act, the four whistleblowers will receive a portion of the $9.8 million settlement as a reward for coming forward with information," says Brous.

The Act was first enacted by Congress in 1863 during the Civil War amid widespread fraud on the Union military by suppliers who would, for example, charge the government twice for the same cavalry horse. The Act encouraged reporting of the fraud by private citizens by providing a 50 percent reward to the whistleblower. The act was scaled way back in 1943, but Congress sweetened it in 1986 as a reaction to reports of widespread fraud and Cold War defense spending under President Ronald Regan. The Act now provides for a 15 to 30 percent reward to whistleblowers.

May 03, 2007 - SHAKOPEE, Minn.--(BUSINESS WIRE)--Saturday's race program at Canterbury Park drew 84 horses, including nine for the featured $45,000 Shot of Gold Stakes. Entries were drawn on Wednesday for the opening day card, which will be run on Saturday, May 5 with first post at 1:30pm.

Many familiar faces have returned to Canterbury including last year's leading rider Paul Nolan. Four-time champion Derek Bell has been named on four mounts, and jockey Tho Nguyen, who last rode at Canterbury in 2002, has returned this season. Trainer Mac Robertson, who has finished atop the standings each of the last three years, wasted no time filling the entry box. Six horses, including a coupled entry in the third running of the Shot of Gold Stakes, will go postward under his name.

Reopened in 1995, the publicly held Shakopee racetrack embarks on its 13th season as Canterbury Park. Track President Randy Sampson expects good things this summer. "The jockey colony looks as strong as ever and the backside stalls should be full within the next few weeks," said Sampson. The purse structure is expected to be consistent with last year, approximately $150,000 per day. "Although first quarter revenues are less than last year and less than expected, I am still confident that we will maintain our purse structure over the course of the meet," added Sampson.

Last year's opening day attracted a record crowd of 17,111. Average attendance has increased each of the last 10 seasons, and Canterbury Park drew more than 360,000 in 2006. "The yearly growth in attendance has been very encouraging," said Sampson. "Weeknight racing has shown tremendous increases, especially among the younger demographic. This has allowed us to introduce the sport of horse racing to a new generation." Hoping to capitalize on that trend, new this year will be 4 pm Saturday post times beginning in June. The change in post time also will allow the Canterbury simulcast signal to reach a broader audience throughout the country. For the first time in its history, Canterbury races will appear in Las Vegas race books.

A complete list of affected brands and products is below.

The Company took this voluntary recall action immediately after learning this morning from the FDA that wheat gluten supplied to Del Monte Pet Products from a specific manufacturing facility in China contained melamine. Melamine is a substance not approved for use in food. The FDA made this finding as part of its ongoing investigation into the recent pet food recall.

The adulteration occurred in a limited production quantity on select product codes of the brands below. This recall removes all Del Monte pet products with wheat gluten procured from this manufacturing facility from retail shelves.

No other Del Monte Pet Products treats, biscuits or wet dog food products are impacted by this recall, and no Del Monte dry cat food, dry dog food, wet cat food or pouched pet foods are subject to this voluntary recall. The affected products comprise less than one-tenth of one percent of Del Monte Pet Products' annual pet food and pet treat production.

Del Monte Pet Products has proactively engaged and fully cooperated with the FDA since the start of its investigation. The adulterated ingredients were used in limited production over the last three months for those items identified by specific product codes. Del Monte Pet Products has not used wheat gluten from this manufacturing facility in China in any other pet products except those described below.

Consumers should discontinue feeding the products with the Product Codes detailed below to their pets.

Lawsuit Claims Nursing Home is Responsible for a Fire That Killed a Disabled Resident

The Wilentz, Goldman & Spitzer, PA, law firm announced that they have commenced a lawsuit on behalf of the family of Ella Mae Johnson, a nursing home resident who died as a result of severe burns sustained in a fire in her room.

Woodbridge, NJ (PRWEB) May 2, 2007 -- The Wilentz, Goldman & Spitzer, PA, law firm announced that they have commenced a lawsuit on behalf of the family of Ella Mae Johnson, a nursing home resident who died as a result of severe burns sustained in a fire in her room at the 'The Health Center at Galloway' in Galloway, New Jersey. The lawsuit (Atlantic County L-1083-07) alleges that the fire and Mrs. Johnson's injuries and death were caused by the nursing home employees' negligence and violation of regulations relating to patient care.

The fire erupted in Ms. Johnson's room engulfing her in bed in the early morning hours of October 26, 2005. According to a fire department investigation, the fire was caused by a cigarette in Ms. Johnson's room. Witness statements taken by investigators from the Galloway Township Police Department state that Mrs. Johnson, an amputee, was not permitted to have cigarettes in her room. Statements taken by investigators confirm that the nursing home's staff was supposed to supervise her smoking and not allow or assist a patient in smoking in a patient room, the location of the fire that severely burned Ms. Johnson and caused her death twenty-five days later. Following the fire, investigators found no matches or lighters in Mrs. Johnson's room.

The lawsuit filed on behalf of the Estate of Ella Mae Johnson seeks compensatory and punitive damages from the owner and operator of the "The Health Center at Galloway."
